The misuse of deepfake technology in India can potentially lead to legal consequences under various existing laws, including:
1. Privacy Violations: The creation and distribution of deepfake images that invade an individual's privacy can be legally implicated under the Indian Penal Code (IPC) and the Information Technology Act, 2000.
Sections 66E (Violation of privacy) and 67 (Publishing or transmitting obscene material) of the Information Technology Act, 2000 can be invoked when deepfakes are employed to breach an individual's privacy or disseminate explicit content without their consent.
2. Defamation: Deepfake images used to portray individuals falsely and harm their reputation can lead to defamation claims under Sections 499 and 500 of the IPC.
Legal actions can be initiated against those who create and disseminate defamatory deepfake content, potentially resulting in imprisonment and fines.
3. Copyright Infringement: Deepfake images often incorporate copyrighted material without proper authorization. The Copyright Act, 1957 safeguards the rights of original content creators.
If deepfake creators use copyrighted materials without permission, they can be held liable for copyright infringement. Legal actions may include damages and the removal of the infringing content.
4. Fraud and Identity Theft: The use of deepfake images for fraudulent activities or identity theft can be prosecuted under several sections of the IPC and the Information Technology Act, 2000.
For instance, Section 419 (Punishment for cheating by personation) and Section 66D (Punishment for cheating by personation using a computer resource) of the IT Act can be invoked against individuals engaged in such activities. Convictions may result in imprisonment and fines.
5. Cybersecurity and Data Protection: The creation and distribution of deepfake images may involve hacking, data breaches, or other cybersecurity violations.
Unauthorized access to personal images or videos often breaches data protection laws, and these breaches can be legally implicated under the Information Technology Act, 2000.
Sections 43A (Compensation for failure to protect data) and 66 (Computer-related offenses) can be used to address cybersecurity violations of this nature.
